Bengal Guv asks staff to ignore any summons by police in sexual harassment probe


West Bengal Governor CV Ananda Bose said on Sunday no inquiry can be conducted against the him as he enjoys immunity by holding a constitutional post, amid the recent allegations of sexual harassment. Bose also directed all staff working in the Raj Bhavan to ignore any communication from the police and asked them not to give any statement.

Earlier, Kolkata Police had even sought CCTV footage and summoned a few persons working in Raj Bhavan. However Bose

instructed them not to appear before the police or any statement online, offline or over phone.”In view of the immunity enjoyed by the Governor, the police are constitutionally barred from carrying out any kind of preliminary inquiry, registering a First Information Report…It is therefore clear that in view of Art.361(2) and (3) of the Constitution of India, the state Police cannot act in any manner whatsoever to inquire/investigate/set in motion any kind of proceedings against the Hon’ble Governor,” Bose said in his statement.

The governor, in a statement which was posted from his Raj Bhawan’s official Handle, cited “Article 361 protection of President and Governors and Rajpramukhs, and (2) No criminal proceedings whatsoever shall be instituted or continued against the President, or the Governor of a State, in any court during his term of office. and (3)No process for the arrest or imprisonment of the President, or the Governor of a State, shall issue from any court during his term of office.”

He also directed the employees of Raj Bhawan not to speak to police.

“In the circumstances all staff/ employees including part time, temporary, DRW or those engaged in Raj Bhavan in any manner are hereby directed to ignore any communication from the police in this respect and refrain from giving any statement online, offline, in person, over phone or in any other manner. This will take immediate effect,” he added.

Earlier, Kolkata Police constituted an eight-member special inquiry team following the complaint of sexual harassment by a young lady, to look into the allegations of molestation against the governor. Police had even sought CCTV footage and summoned a few persons working in Raj Bhavan. However, they did not appear before the police.

Meanwhile, Abhishek Banerjee, from a public rally, in Bengal, slammed the governor over the alleged sexual harassment of a helpless young girl.
